Terms and conditions

Introduction:

These terms and conditions constitute a contract between you, the participant, and us, "The Island Challenge," governing the provision of our services/expeditions. This contract becomes binding when you, the participant, have made the deposit payment, and we have confirmed it in writing. Please read these terms carefully as they define the agreed conditions of our expedition.

Definitions:

  • "We" or "The Island Challenge" refers to The Island Challenge.

  • "You" or "The participant" refers to any participant in an expedition with The Island Challenge who is not an employee of the company.

  • "Expedition" or "Trip" or "Adventure" refers to any journey offered by us, as mentioned on our website www.theislandchallenge.com.

The Contract:

 

The contract based on these terms and conditions is exclusively between the named participant(s) and The Island Challenge. Both parties agree that French law will apply to this contract, and any claims must be dealt with exclusively by the courts of French Polynesia. No variation of this contract is acceptable except in writing by both parties at least one month before the relevant expedition's start date.

Expedition Booking:

 

To make a reservation on our website, participants must be over 18 years old. If the reservation involves multiple people, the main participant must be authorized by all named individuals on the reservation and by their parent or guardian for family members under 18 years old at the time of booking (applies only to family expeditions). The main participant is responsible for all payments. All individuals named on the reservation must be 18 years old at the departure date.

Payment:

 

A non-refundable deposit (or full payment if the reservation is made within 90 days before departure) is required to confirm your chosen expedition. The balance must

reach us at least 90 days before departure. Payments can be made by bank transfer or credit card (a 2% surcharge applies for credit card payments). Non-payment on time may lead us to assume your desire to cancel the reservation.

Changes:

 

By the Participant: Changes to a confirmed expedition must be notified in writing. Changes of expedition dates or destination (up to 90 days before departure) are accepted once without charges. Further changes are subject to a $50 fee.

By The Island Challenge: We reserve the right to make changes to expeditions due to unforeseen circumstances. Significant changes will be communicated, and participants can choose to accept the changes, transfer to an alternative expedition, or cancel with a full refund.

Cancellation:

 

By the Participant: Cancellation charges apply based on the period before departure, ranging from the deposit for cancellations 90 days or more before departure to 100% for cancellations 45 days or less before departure.

By The Island Challenge: We may cancel or postpone expeditions due to unforeseen circumstances. In such cases, all payments will be refunded, or alternatives will be offered.

Responsibility:

 

We commit to providing expedition arrangements with reasonable skill and care. We are not responsible for injuries, illnesses, deaths, losses, damages, or expenses resulting from the actions of participants, third parties, or force majeure events. Participants are responsible for obtaining and carrying all necessary legal, travel, insurance, and health documents.

Assumption of Risk:

 

Participants acknowledge the inherent risks in expeditions and participate at their own risk. The Island Challenge cannot be held responsible for accidents or illnesses, except in cases of gross negligence on our part.

Participant Conduct and Damages:

 

Participants must adhere to safety instructions. Non-compliance may result in expulsion from the expedition, and additional costs will be charged. The Island Challenge is not responsible for personal belongings and valuables brought to the island by participants.

Complaints and Problems:

 

In case of complaints or problems during the expedition, participants must inform our local representative immediately. Until we are informed of a complaint or problem, we cannot begin to resolve it. Most problems can be resolved quickly. If you remain dissatisfied, you must write to us within 28 days of your return, providing your booking reference and full details of your complaint.

 

 

Changes to the Terms and Conditions:

 

The Island Challenge may update these terms and conditions from time to time, and it is the participants' responsibility to ensure they are aware of and agree to any modifications before joining any course.
